Shaw Networks reserves the right to modify this Agreement and any services it provides at any time, as deemed appropriate. You will be notified of material changes via email or a notice on our website at least 14 days in advance. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms. It is your responsibility to remain aware of any updates to this Agreement.
You agree that any changes to the information provided during initial registration will be communicated to us within five (5) days of such changes. Failure to update your information, failure to respond to our verification requests within five (5) days, or provision of inaccurate, incomplete, false, or misleading information constitutes a material breach of this Agreement and may result in account suspension or termination. Shaw Networks reserves the right to verify any information provided at any time.
Shaw Networks maintains a separate Privacy Policy, which forms part of this Agreement by reference. Your personal information will be handled strictly in accordance with that policy and will never be used outside its stated bounds. You can review the full Privacy Policy at any time via the link in our website footer.
You agree not to engage in any of the following activities while using Shaw Networks services:
Any violation of network or systems security is expressly prohibited and will be pursued both criminally and civilly where applicable. Prohibited activities include unauthorized hacking, port scanning, packet probing, systems scans, data interception, unauthorized access, traffic monitoring of other users, mail bombing, TCP/IP header forgery, and any deliberate interference with service to other users or systems. Shaw Networks will cooperate fully with law enforcement in the investigation and prosecution of any such violations.
Shaw Networks operates a shared hosting environment, and fair-use resource limits are enforced via CloudLinux LVE to protect all customers. You agree not to run scripts or processes that consume excessive CPU, memory, or I/O resources. Sustained use exceeding your account’s allocated limits will result in contact from our team to discuss optimization or an upgrade. Running public recursive DNS services is prohibited; servers found in violation will be removed without prior notice.
You may not resell, sublicense, or provide access to your hosting account to non-account holders. You may not provide free sub-hosting, subdomains, or email accounts to third parties through your account. Discovery of such activity will result in immediate suspension or termination.
You are responsible for preventing excessive load on Shaw Networks DNS systems. Should you exceed your allocated bandwidth, additional fees may apply. You may not use your account as a source, intermediary, or destination for mail bombing, packet flooding, service denial, or any other abusive network activity. Disseminating information about hacking or security breach techniques, including links to such content, is prohibited and will result in immediate account removal. You may not use your account as an anonymous proxy gateway, nor may you use our services to impede any other user’s access to the internet or to destabilize the Shaw Networks network.
Where Shaw Networks provides licensed software as part of your hosting service (including cPanel and related tools), your use is limited to ordinary and common use as defined by Shaw Networks. Such licenses are non-transferable, may not be used on more than the designated hosting environment, and may not be altered, reverse-engineered, or integrated with unauthorized third-party software. Shaw Networks retains all copyright and ownership of its licensed software, which is provided “as is” without warranty of any kind.
Shaw Networks will host your account based on your chosen plan, domain name(s), and billing term. Each contract automatically renews at the end of each term unless you provide cancellation notice via the client portal. Upon receipt of a cancellation request, Shaw Networks reserves the right to remove your account from the server. It is your sole responsibility to ensure that you and any other authorized parties have retrieved all necessary files, data, and content before submitting a cancellation request. Shaw Networks bears no responsibility for any data loss following receipt of a cancellation notice.
You agree to use Shaw Networks services exclusively for purposes that are lawful under all applicable local, national, and international laws. Our services are intended for the hosting of web documents and are not to be used as general file storage or backup repositories, as further described in the Acceptable Usage Policy. Violations may result in suspension or termination of your account without notice, at Shaw Networks’ sole discretion. Shaw Networks reserves the right to refuse service to any account whose content or linked content is deemed illegal, obscene, fraudulent, or in breach of this Agreement or the Acceptable Usage Policy.
All prices for Shaw Networks services are as communicated to you at time of purchase. Shaw Networks reserves the right to modify pricing at any time, with notice provided via email or posted on our website. It is your responsibility to remain informed of any pricing changes. Unlike many hosting providers, it is our policy not to increase renewal pricing beyond initial purchase pricing; however, Shaw Networks retains the right to adjust pricing with appropriate notice.
You accept full responsibility for the security of your account, credentials, and any content stored within it. Any breach of account security resulting from your own acts or omissions is your sole responsibility. Shaw Networks will not process password changes without sufficient proof of identity. In the event of a legal dispute over account ownership (such as dissolution of a partnership or a divorce proceeding), Shaw Networks will remain neutral and may place a hold on the affected account(s) until the matter is legally resolved. You agree Shaw Networks is not liable for any losses incurred during such holds and agree to hold Shaw Networks harmless for any claims arising from ownership disputes.
Should you choose to display advertising or incorporate content from third parties on your hosted website, you accept full responsibility for that content. Any third-party content that violates the Acceptable Usage Policy — including content that is offensive, illegal, obscene, or otherwise inappropriate — is considered a breach of this Agreement and may result in account suspension or termination.
Payment for services is due at the time of order. Payments and fees are non-refundable in the event of account suspension, termination for violations of this Agreement or the Acceptable Usage Policy, or transfer of services before the end of the current contract term.
Shaw Networks offers a 30-day money-back guarantee on first-time shared hosting purchases. Beyond the initial 30 days, no refunds will be issued. The following are non-refundable under all circumstances: SSL certificates, domain registration fees, and any add-on services explicitly stated as non-refundable at the time of purchase.
Shaw Networks may alter pricing and will notify you via email or website notice. It is your responsibility to remain informed of any changes.
For monthly billing, your renewal date is the same day of the month as your original order date. For annual billing, renewal occurs on the anniversary of your signup date. If payment cannot be collected for any reason, you agree to rectify the issue immediately. Failure to do so within the stated grace period will result in service suspension and, subsequently, termination, along with any applicable reinstatement fees and administrative costs incurred during collection attempts.
All transactions are processed in US dollars. Where an estimated price is displayed in another currency, that estimate is provided for convenience only and the actual charge is in USD. Exchange rate fluctuations between order placement and payment processing are your responsibility. VAT or other applicable taxes may be added at checkout based on your billing address and applicable law.
Shaw Networks provides its services “as is” without any express or implied warranty of fitness for a particular purpose or merchantability. Shaw Networks does not guarantee that services will be uninterrupted, error-free, or entirely secure. To the maximum extent permitted by applicable law, Shaw Networks shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use our services, including but not limited to loss of data, revenue, or profits, even if Shaw Networks has been advised of the possibility of such damages. Our total liability shall not exceed the fees you paid to Shaw Networks in the 90 days preceding the claim.
You agree to indemnify, defend, and hold harmless Shaw Networks and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of our services, your content, your breach of this Agreement, or any violation of applicable law. Should Shaw Networks be named in any legal action relating to your use of our services, you agree that Shaw Networks may select legal counsel of its choosing and that all associated costs will be your responsibility.
You are responsible for providing Shaw Networks with notice of your intention to terminate services. Notice should be submitted via the client portal between 3 and 10 days before your next billing date. Shaw Networks reserves the right to immediately suspend or terminate accounts found to be in violation of this Agreement or the Acceptable Usage Policy, with or without prior notice depending on the severity of the violation.
By accepting this Agreement, you affirm that you are of legal age in your jurisdiction to enter into a binding contract.
Neither party shall be held liable for failure to perform any obligation under this Agreement due to circumstances beyond their reasonable control, including but not limited to: natural disasters, acts of God, war, civil unrest, terrorism, labor disputes, supplier failures, or changes in applicable law or government regulation. The party affected by such an event must notify the other party within five (5) days. If the impact persists for more than 30 days, Shaw Networks may terminate the Agreement entirely.
Nothing in this Agreement shall be construed as creating a joint venture, partnership, agency, or employment relationship between you and Shaw Networks. Neither party is authorized to act on behalf of the other in any capacity.
Any waiver by Shaw Networks of a provision of this Agreement shall apply on a one-time basis only and shall not constitute a continuing waiver. If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force and effect.
You may not assign, sell, or transfer your account or rights under this Agreement to any third party without prior written consent from Shaw Networks. Shaw Networks reserves the right to void this Agreement in its entirety should any creditor of yours attempt to attach rights to it. You agree not to resell, lease, or otherwise commercially exploit our services without our express written consent.
This Terms of Service, together with the Privacy Policy and Acceptable Usage Policy, constitutes the entire agreement between you and Shaw Networks and supersedes all prior proposals, agreements, or representations, whether written or oral. This Agreement may not be modified by you without a written amendment signed by an authorized representative of Shaw Networks.
